Statutory attorney and executor fees are generally calculated as a percentage of the estate’s gross value (the full value of the estate before subtracting mortgages or other debts), not your net equity. Together with court costs, probate can cost families tens of thousands to hundreds of thousands of dollars.

A properly prepared and funded revocable living trust lets your successor trustee transfer assets directly to your beneficiaries without probate or court supervision. It also lets you, not California’s intestate succession laws, decide who inherits, what they receive, and when. And you keep control of your assets during your lifetime while naming someone you trust to manage them if you become incapacitated.

At Pacific Motion Law Firm, our San Jose estate planning attorney helps individuals, couples, and families throughout California build estate plans around a revocable living trust, so more of what you’ve worked for reaches the people you choose.

Our Complete Estate Plan: What’s Included

Our complete estate planning package brings together eight (8) core components to address your property, financial decisions, health care wishes, and family needs. All eight items listed below are included in our complete estate planning package for one flat-rate fee. Your fee covers preparation of these estate planning documents, all notarization costs, and county recording fees, with no hidden fees. We also include one free trust amendment or update within 15 years of your trust’s creation. We tailor the documents to your circumstances, including separate documents for both spouses where applicable, and planning for minor children when needed. The eight (8) core components of our complete estate planning package are:

1. Living Trust Agreement & Supporting Trust Documents
Your package includes the main living trust agreement, declaration of trust, certification of trust, and assignment of personal property to the trust. Together, these documents establish your trust, identify who will manage it, and set out your instructions for the property and beneficiaries covered by your plan. When properly prepared and funded, your living trust can help your loved ones avoid probate and its high fees.

2. Pour-Over Will
A supporting will provides a backup plan for assets that were not properly transferred to your living trust during your lifetime. For a married couple, we prepare a pour-over will for each spouse. Assets passing under a pour-over will may still require court proceedings.

3. Durable Financial Power of Attorney
Designate a trusted person to handle authorized financial and legal matters if you become unable to manage them yourself. For a married couple, each spouse receives a separate financial power of attorney so both have a plan for assistance during incapacity. Plan ahead while you still have legal capacity. You can appoint your chosen agent through a durable financial power of attorney now. If you wait until you have lost the required capacity, you may no longer be able to sign this document, and your family may need to petition the court for a conservatorship if no adequate alternative is available. Depending on the complexity of the case, conservatorship proceedings can cost $6,000 to $20,000 or more, in addition to annual bond premiums if the court requires a bond for management of your estate.

4. Advance Health Care Directive & Health Care Power of Attorney
Identify the person you want to make health care decisions when you cannot make them yourself and document your treatment preferences. For a married couple, we prepare separate health care documents for each spouse. Make these decisions before incapacity takes away your ability to do so. An advance health care directive with a health care power of attorney lets you choose your decision-maker and record your wishes while you have legal capacity. Without advance planning, your family may need to seek a court-appointed conservator if no legally authorized surrogate or other adequate arrangement is available. Depending on the complexity of the case, conservatorship proceedings can cost $6,000 to $20,000 or more. Annual bond premiums may also apply if the conservatorship includes management of your estate and the court requires a bond.

5. Planning for Minor Children
When you have minor children, the package includes applicable designations for health care and financial agents and nomination of a guardian. These documents record whom you want to care for your children and help with their needs if you cannot. A guardian’s appointment remains subject to court approval.

6. Final Disposition of Remains Instructions
Record your wishes concerning burial, cremation, or other arrangements so your loved ones have clear instructions instead of having to guess. For a married couple, each spouse can document their own preferences.

7. Marital Property Agreement
For married clients, an appropriate marital property agreement clarifies the intended community property character of covered assets and coordinates that treatment with the estate plan to ensure that the surviving spouse and, eventually, the children named as beneficiaries receive the maximum step-up in basis for capital gains tax purposes.

8. Grant Deed Preparation & Recording
We prepare the appropriate grant deed to transfer real property into your living trust and arrange recording with the county for you. This important funding step helps put your plan into effect by connecting ownership of the property with the trust.

An Estate Plan’s Value Depends on What It Includes and Whether It Is Properly Completed.

Whether you work with an attorney or a nonlawyer document service, look beyond the advertised price. Compare the eight components above and ask whether every item applicable to your circumstances is included. A low price is not a good value if essential documents or critical steps are left out which may ultimately defeat the purpose of your living trust.

For California homeowners, Item 8 – Grant Deed Preparation & Recording – deserves particular attention. Preparing a living trust without completing the appropriate transfer of your real estate can leave a serious gap in your estate plan. Your home and other California real estate may be among your most valuable assets. If they remain outside your trust, your loved ones could still face court proceedings – the very process you intended to avoid.

You deserve more than a binder of documents. You deserve an estate plan that is properly put into effect. At Pacific Motion Law Firm, our complete estate planning package includes preparing and recording the appropriate grant deed to transfer your real property into your living trust, helping ensure that this critical step is completed.

Put your plan into effect

Trust Funding & Real Estate Transfer Services

Already created your living trust but haven’t completed the funding? Whether your trust was prepared by another attorney, a nonlawyer document service, or on your own, we can help you complete this final but critical step. If you are struggling to transfer your home, accounts, or other assets into your trust, Pacific Motion Law Firm offers separate trust funding services, even if we did not prepare your original trust. We review your existing trust and asset ownership, identify the funding steps needed, and assist with the appropriate transfer documents and follow-up requirements.

For California real estate, we assist with reviewing ownership, preparing appropriate deeds, and addressing the documentation involved in transferring property into a living trust. We also help clients consider how a newly purchased home, a refinance, or a later ownership change may affect their existing plan. Account ownership and beneficiary designations should be reviewed individually; the same approach is not appropriate for every asset.

Trust funding services are normally offered for a flat-rate fee, with the fee determined by the complexity of the funding involved. We discuss the scope of work and applicable fee with you before proceeding. Whether your plan involves a residence, rental property, or an interest shared with family members, we can help you address unfinished funding and put your existing trust into effect. Even if you do not need a trust, a durable financial power of attorney and an advance health care directive remain essential planning tools for a time when illness, injury, or incapacity prevents you from making decisions or handling your own affairs.

A durable financial power of attorney allows you to authorize a trusted agent to act on your behalf if you become incapacitated. Depending on the authority granted, your agent can access your bank accounts and withdraw funds to pay your living expenses, manage bills and other financial obligations, handle tax matters, and assist with applications for public benefits. Signing and filing income tax returns on your behalf requires specific authority and compliance with applicable tax rules; benefit applications may also require separate agency authorizations.

An advance health care directive with a health care power of attorney lets you choose someone to communicate with your doctors, obtain relevant medical information as authorized, and make timely health care decisions when you cannot make them yourself. It also records your treatment preferences so your chosen decision-maker has guidance about the care you want.

Preparing these documents in advance can help your loved ones act without first seeking a court-appointed conservator. If you wait until you no longer have the required legal capacity, it may be too late to sign them. Without these documents or another adequate arrangement, a costly conservatorship proceeding may be necessary to obtain authority to manage your finances or personal care when you become incapacitated.

Our firm offers standalone powers of attorney and advance health care directives for a flat-rate fee for clients who choose not to establish a living trust or who simply need these documents separately. We help you choose your agents, define their authority, and document your wishes before a crisis occurs.

Keep your plan current

Trust Amendments & Estate Plan Updates

An estate plan should be reviewed as your life changes. Marriage, divorce, the birth of a child, a death in the family, a new home, or a change in your financial circumstances may affect the instructions in an existing trust or will. You may also want to change a beneficiary, successor trustee, financial agent, or health care decision-maker.

We review existing estate planning documents and discuss whether a focused trust amendment, a more comprehensive trust restatement, or updated supporting documents would better address your needs. The available options depend on the terms of the trust, the people with authority to make changes, and the circumstances at the time of review.

Our review also considers whether the documents remain consistent with your property ownership and intended distributions. Bring your current trust, amendments, wills, and relevant property information so we can evaluate the plan as a whole.

Planning for more complex needs

Special Needs, Irrevocable Trusts & Medi-Cal Planning

Some families need planning beyond a standard revocable living trust. A beneficiary with a disability, concerns about long-term care, or specific goals for an inheritance may call for a different trust structure. We help clients explore specialized planning based on their assets, family circumstances, and the needs of the intended beneficiaries.

A properly structured special needs trust may provide supplemental support while preserving eligibility for applicable public benefits. The source of the funds, trust terms, and administration requirements matter. We help families consider how an inheritance or other resources can be coordinated with a beneficiary’s ongoing needs.

Irrevocable trusts can serve particular planning purposes, but they involve different limits on control and modification. Medi-Cal planning likewise requires an individualized review of current eligibility and transfer rules. Creating a trust does not automatically establish eligibility or protect every asset. We discuss the available options and their implications before recommending a course of action.

Guidance after a loved one’s death

California Probate Administration

After a family member dies, determining how to transfer property can feel overwhelming. Whether formal probate is needed depends on the ownership of the assets, the estate planning documents, and the procedures available under California law. We help families review these issues and understand the next steps.

When probate administration is required, we assist with the court process and related documentation, including petitions, required notices, identification of estate assets, and the steps toward an authorized distribution. We also help address probate-related real property documentation and explain the responsibilities involved in acting as a personal representative.

If a living trust or another transfer procedure may apply, we review that possibility as part of the initial assessment. Our goal is to help you understand the appropriate process for the property involved and move forward with clear guidance.

Resolve omitted assets & property title issues

Heggstad & Spousal Property Petitions

A trust or estate may include property that was omitted from a transfer document or remains incorrectly titled. In appropriate circumstances, a Heggstad petition can ask the probate court to confirm that an asset belongs to a trust. Whether that remedy is available depends on the trust documents, evidence concerning the property, and the applicable legal requirements; an omitted asset does not automatically qualify.

A Spousal Property Petition may allow a surviving spouse or registered domestic partner to obtain a court determination concerning qualifying property without full probate administration of that property. We review ownership records and estate planning documents to evaluate whether this procedure fits the circumstances.

We assist with reviewing the relevant records, preparing petitions and supporting documents, and addressing related property transfer documentation. In California, a will alone does not avoid probate. Unless its value falls within California’s small-estate limits, a home or other real estate left only through a will generally must go through the court probate process before it can be transferred to your heirs.

If I have a living trust, do I still need a will?
Yes. A pour-over will serves as a safety net for any assets that were not transferred to your trust during your lifetime, directing them into your trust, although those assets may still need to go through court proceedings. Our complete estate planning package always include a pour-over will.

What does it mean to “fund” my trust?
Funding means transferring your assets into the name of your trust, such as recording a new deed that transfers your home to you as trustee of your trust and retitling bank and investment accounts. A trust that is signed but never funded may not avoid probate for the assets left outside it. Learn more about our trust funding and real estate transfer services.

Will transferring my home to my living trust change my property taxes or mortgage?
Generally, no. In California, transferring your home to your own revocable living trust usually does not trigger a property tax reassessment.

Can I change my living trust after it is signed?
Yes. A revocable living trust can be amended or restated during your lifetime, as long as you have the capacity to do so.
