Deeds & property title transfers

Property Title Transfer and Deed Services

We provide attorney-prepared deed and title transfer services for real property. Whether you are transferring ownership between family members or anyone, adding or removing a spouse from title, transferring property into or out of a trust, correcting a previously recorded deed, or changing the way title is held, we can prepare and record the appropriate deed for your transaction.

Our Deed Preparation and Title Transfer Services

  • Grant Deeds
  • Quitclaim Deeds
  • Trust Transfer Deeds
  • Interspousal Transfer Deeds
  • Deed Correction and Corrective Deeds

Flat-Rate Fee: $500 per Deed

Our flat-rate fee is $500 per deed, which includes or covers:

  • Property title search
  • Attorney review and preparation of the deed
  • Notarization at our office
  • County or Government recording fees
  • Recording of the deed with the appropriate County Recorder

Unlike online forms or nonlawyer document preparation services, your deed is prepared and reviewed by an attorney with attention to the existing chain of title and the legal effect of the transfer.

Deed Correction Services

NOTE: Deed correction services are applicable when a previously recorded deed contains an error that creates a title issue (not property tax issue). Depending on the circumstances, this may involve preparing a corrective deed, or other appropriate document to address issues such as misspelled names, incorrect vesting, incorrect legal description of the property, omitted information, inaccurate grantor or grantee descriptions, or other recording and title defects.

Contact our office for deed preparation, deed correction, and title transfer services.

Deed cancellation & reassessment reversal services

Cancellation of Erroneous Deed/Transfer Services

If you previously completed an erroneous property transfer that resulted in an unintended property tax reassessment (a significant increase in annual property tax), we may be able to help correct the prior transfer through a cancellation of the erroneous transfer and assist in seeking a reversal of property tax reassessment, where appropriate.

We have successfully assisted many clients in seeking property tax reassessment reversals through cancellation of prior erroneous transfers. To date, our success rate in these matters has been 100%.

Past results, however, do not guarantee a similar outcome in any future matter. Every case depends on its own facts, documentation, timing, and the determination of the applicable county assessor or other governmental agency.

Deed cancellation matters are complex. Please contact our office for applicable rates and fees.

Affidavits of death & clearing title

Affidavit of Death & Removal of Deceased Co-Owner Services

We assist surviving property owners, spouses, and trustees with the documents needed to address a deceased co-owner or trustee on the recorded title to real property. Our services include preparing and recording the appropriate affidavit and related documents, including:

  • Affidavit of Death of Joint Tenant – to remove a deceased joint tenant’s name from the property title and confirm the surviving joint tenant’s ownership of the deceased owner’s share.
  • Affidavit of Surviving Spouse Succeeding to Title – to remove a deceased spouse’s name from the property title and confirm the surviving spouse’s ownership, when the property passes to that spouse by right of survivorship.
  • Affidavit of Death of Trustee – to remove a deceased trustee’s name from the property title and identify the surviving or successor trustee who will manage the property under the trust.

Many people assume that the government automatically removes a deceased co-owner’s name from title when property is held in a form of title with right of survivorship such as a joint tenancy or as community property with right of survivorship. Although ownership may pass to the survivor by operation of law, the recorded chain of title is not automatically updated simply because a co-owner has died. The surviving owner generally needs to record the appropriate affidavit, together with a certified death certificate and any other required documents, to document the death and clarify title.

We review the existing deed and relevant trust documents, help determine which affidavit is appropriate, and assist with document preparation, notarization, and recording. Taking these steps can help address title issues before a future sale, refinance, or other property transaction.
